kove

kove terms of use

Draft. Effective date to be set at launch, after review by counsel.

These terms are the agreement between you and kove. They are written to be read. The short version: kove is an information tool for reading supplement labels, not medical advice; your clinician stays in charge; you own what you add; we own the app; and if something goes wrong between us, we would rather fix it than fight about it.

1. Who we are, and what you are agreeing to

kove is an iOS app made by Leo Athletics LLC, doing business as kove ("kove", "we", "us"). By creating an account, tapping "I understand" in the app, or using kove in any way, you agree to these Terms of Use and to our Privacy Policy. If you do not agree, do not use kove.

This agreement is between you and kove only. Apple is not a party to it and is not responsible for kove or its content. Apple does have the right to enforce these terms as a third-party beneficiary, as its App Store rules require.

2. What kove is, and what it is not

kove reads a supplement's label or barcode, compares what the label says against public evidence, and returns a quality score with a plain-language explanation. It is a general wellness product.

kove is an information tool, not a medical service. It does not diagnose, treat, cure, or prevent any disease or condition, and it does not replace your clinician, pharmacist, or any other healthcare professional. Nothing in kove is medical advice, and nothing in kove is a recommendation to take, stop, or change any supplement or medication. Talk to a healthcare professional before you start, stop, or change any supplement or medication, especially if you are pregnant, nursing, taking prescription medication, or managing a health condition.

A score is kove's opinion of a product's label, formed from the label, public databases, and published research, under a scoring system we document and revise. It is not a laboratory test of the bottle in your hand. Products change, labels change, and research changes. Two people scanning the same product see the same score; the score is about the product, not about you.

If you think you are having a medical emergency, call 911 or your local emergency number. Do not use kove to decide whether something is an emergency.

3. Who can use kove

You must be at least 18 years old to use kove. By using kove you confirm that you are. kove is not directed at children, and we do not knowingly collect information from anyone under 13; if we learn we have, we delete it.

4. Your account

Scanning requires an account, created with Sign in with Apple. Keep your Apple account secure; what happens under your kove account is your responsibility. You can sign out, export your data, or delete your account at any time from Profile. Deleting your account removes your records from our servers as described in the Privacy Policy.

5. kove Premium, free trials, and payment

The core of kove is free: scan a bottle, see its score, keep a basic stack. kove Premium adds search without a bottle, unlimited history, full stack analysis, and the features we add over time.

6. What you add to kove

Your stack, your notes, your goals, your scan history, and anything else you enter are yours. You give kove a license to store and process them to run the app for you, as the Privacy Policy describes, and for nothing else. We do not sell them.

When you scan a product, the parsed product (its name, brand, ingredients, and score, never your identity) joins a shared cache so the next person who scans the same bottle gets an instant result. Corrections you make to a product's reading may improve that shared record. That contribution is anonymous and permanent, and it is part of how kove works.

You are responsible for what you enter. Do not enter anything you do not have the right to share, and do not enter another person's health information without their permission.

7. What belongs to kove

The app, the scoring system, the summaries, the design, the name kove, and the marks that go with it belong to Leo Athletics LLC or its licensors and are protected by copyright, trademark, and other law. We give you a personal, limited, non-transferable, revocable license to use the app on Apple devices you own or control, under Apple's App Store terms and these terms, for your own non-commercial use. You may not copy, modify, resell, reverse engineer, scrape, or build a product on kove's scores, summaries, or data, and you may not remove any notice of ownership. Public label data and published research belong to their sources.

Where the law gives you rights that these restrictions cannot remove, those rights stand.

8. Acceptable use

Use kove as a person reading labels for yourself or your household. Do not use it to break the law, to harm anyone, to gain access to our systems or another person's account, to overload or disrupt the service, to train a model or build a dataset from its output, or to misrepresent kove's scores as endorsements or medical findings. We may suspend or close an account that does.

9. Third-party content and services

kove draws on public sources (such as the NIH Dietary Supplement Label Database), brand and retailer websites, and AI services that read labels and write summaries. We do not control those sources and do not vouch for them. A link out of kove is a convenience, not an endorsement. kove does not take money from supplement brands for ratings, placement, or coverage.

10. No warranty

kove is provided "as is" and "as available". To the fullest extent the law allows, kove and Leo Athletics LLC make no warranty of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not promise that a score is correct, complete, or current; that the app will be available, uninterrupted, or error-free; or that a product kove scores well is safe or right for you. Supplement labels can be wrong, and kove reads the label.

Apple has no obligation to furnish maintenance or support for kove; that is on us. If kove fails to conform to an applicable warranty that the law does not let us disclaim, you may notify Apple and Apple may refund the purchase price to you; beyond that, Apple has no other warranty obligation for kove.

11. Limitation of liability

To the fullest extent the law allows, kove, Leo Athletics LLC, and its owners, employees, and agents are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, health, profits, or goodwill, arising from or connected with kove or these terms, however caused and under any theory of liability, even if we were told such damages were possible.

Our total liability to you for all claims arising from or connected with kove, in any twelve-month period, will not exceed the greater of (a) the amount you paid kove for Premium in that period and (b) fifty US dollars (US$50).

Some places do not allow some of these limits. In those places, the limits apply as far as the law allows. Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by our gross negligence or willful misconduct, or for fraud.

12. Your responsibility to us

You agree to defend and hold harmless kove and Leo Athletics LLC from claims, losses, and costs (including reasonable legal fees) arising from your misuse of kove, your breach of these terms, or content you enter that violates someone else's rights.

13. Product and intellectual-property claims

kove, not Apple, is responsible for addressing any claim that the app fails to conform to a legal or regulatory requirement, any product-liability claim, any consumer-protection claim, and any claim that the app infringes a third party's intellectual-property rights, to the extent these terms permit. If you believe content in kove infringes your rights, write to support@heykove.com with enough detail for us to find and assess it.

14. Ending things

You can stop using kove at any time and delete your account from Profile. We may suspend or end your access if you breach these terms, if the law requires, or if we discontinue kove, and we will tell you why where we can. Sections 2, 6, 7, 10, 11, 12, 15, and 16 survive the end of this agreement.

15. Disputes

Talk to us first. If you have a problem with kove, write to support@heykove.com. Most things are fixable, and we would rather fix them. Both of us agree to try in good faith to resolve any dispute informally for at least 30 days before starting any formal proceeding.

Arbitration. If we cannot resolve it informally, you and kove agree that any dispute arising from or relating to kove or these terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either of us may bring an individual claim in small-claims court, and either of us may seek an injunction in court to protect intellectual-property rights. The arbitration will be held by video or in the county where you live, and kove will pay the filing and arbitrator fees for claims under US$10,000 unless the arbitrator finds the claim frivolous. The Federal Arbitration Act governs this clause.

No class actions. You and kove each agree to bring claims only in your individual capacity, not as a plaintiff or class member in any class, consolidated, or representative proceeding. If this waiver is found unenforceable for a particular claim, that claim proceeds in court, not in arbitration.

Opt out. You can opt out of this arbitration clause by emailing support@heykove.com within 30 days of first accepting these terms, with the subject "Arbitration opt-out" and the email on your account. Opting out does not affect the rest of these terms.

Rights the law keeps for you. Nothing in this section waives a right that cannot be waived, including the private right of action under the Washington My Health My Data Act for Washington residents.

16. Governing law

These terms are governed by the laws of the State of Illinois, United States, and the Federal Arbitration Act, without regard to conflict-of-law rules, except where the law of the place you live gives you protections that cannot be taken away. For anything that goes to court, you and kove agree to the state and federal courts located in Kendall County, Illinois, unless the law requires otherwise.

17. Legal compliance

You confirm that you are not located in a country subject to a US government embargo or designated as a "terrorist supporting" country, and that you are not on any US government list of prohibited or restricted parties.

18. Changes to these terms

We will update these terms when kove changes or the law does. Material changes will be announced in the app at least 30 days before they take effect, and the current version always lives at heykove.com/terms. Using kove after a change takes effect means you accept it; if you do not, stop using kove and delete your account.

19. The rest

These terms, with the Privacy Policy (and, once it is published, the Consumer Health Data Privacy Policy), are the whole agreement between you and kove about the app. If a part of them is found unenforceable, the rest stands. If we do not enforce a term once, we can still enforce it later. You may not transfer this agreement; we may transfer it to a successor that takes on kove, and we will tell you if we do. Third parties have no rights under these terms except Apple, as described above.
